Social media content has become a routine component of modern litigation but introducing that evidence at trial presents complex evidentiary challenges. This program examines the admissibility of social media evidence, with particular focus on authentication, hearsay, admissions of a party-opponent, and foundational requirements. The course also addresses discovery obligations, spoliation concerns, the Stored Communications Act, and practical methods for obtaining and preserving social media data. Through review of cases involving emails, text messages, and social networking sites, attendees will gain practical guidance on laying a proper foundation and avoiding evidentiary pitfalls when offering—or challenging—digital evidence.
