Description

This Continuing Legal Education course provides practical strategies and techniques for delivering effective opening statements and conducting cross-examinations of difficult expert witnesses. Attendees will learn how to frame compelling narratives in opening statements, avoid common pitfalls, and master the art of questioning expert witnesses. Special emphasis is placed on handling complex testimony from experienced experts, attacking credibility, and preparing thoroughly to succeed in cross-examination.

Learning Objectives:

  1. Structure a strong, compelling opening statement that sets the tone for trial.
  2. Employ effective delivery techniques, such as concise, clear, and credible presentation styles.
  3. Apply strategies for cross-examining difficult expert witnesses, including attacking credibility and using constructive questioning.
  4. Identify and avoid common pitfalls in cross-examinations, such as over-questioning and missteps in credibility attacks.
  5. Prepare thoroughly for trial, including understanding key legal issues, reviewing deposition transcripts, and anticipating expert witness testimony.

Nathan G. Osborn is an Equity Shareholder with Montgomery Little & Soran, specializing in real estate litigation, transactions, and commercial litigation. Licensed in Colorado and Nebraska, he serves as a full-service corporate attorney for real estate and medical businesses and can be hired as an expert witness in real estate, attorney fees, and trial-related cases. With significant trial experience, Mr. Osborn helps transactional clients avoid court situations, while his transactional expertise benefits his litigation cases. He handles a variety of matters, including real estate title disputes, title insurance, boundary disputes, landlord-tenant issues, foreclosures, and more.
