This timely and in-depth CLE, presented by attorney and sports law professor Dominique Price, traces the legal evolution of Name, Image, and Likeness (NIL) rights in college athletics. Beginning with the seminal O’Bannon v. NCAA decision, the session explores key legal milestones—including Alston v. NCAA and state legislative developments—culminating in the groundbreaking 2024 House v. NCAA settlement. Participants will examine the impact of antitrust law, the shifting legal framework governing amateurism, and how recent litigation is reshaping the business and legal landscape of college sports. Attendees will gain insights into the compliance challenges and opportunities facing universities, student-athletes, and legal professionals advising stakeholders in this rapidly evolving space.
Learning Objectives:
1. Describe the foundational antitrust arguments in O’Bannon v. NCAA and how they established the legal basis for NIL rights.
2. Analyze how Alston expanded student-athlete compensation and set precedent for further challenges to NCAA restrictions.
3. Evaluate the impact of state NIL statutes and the NCAA’s interim NIL policy on collegiate athletics.
4. Examine recent and pending litigation (House, Carter, Bewley, Tennessee, Ohio) and their potential to reshape the NIL landscape.
5. Identify key compliance issues for attorneys advising schools, athletes, or sponsors in the NIL era.
