Description

Navigating the complexities of Medicaid, Long-Term Care (LTC) Insurance, and alternative funding options is crucial for legal professionals working in elder law and estate planning. This Continuing Legal Education (CLE) course provides a comprehensive overview of Medicaid eligibility guidelines, application procedures, and strategies for funding long-term care without solely relying on Medicaid. Participants will gain insights into the intricate rules governing Medicaid asset and income eligibility, as well as explore alternative avenues such as LTC insurance, Medicare, State Partnership Plans, and Veterans Benefits. Through practical examples and case studies, attendees will enhance their understanding of the nuances involved in advising clients on long-term care planning and asset protection.

Learning Objectives:

1.    Understand the current Medicaid eligibility guidelines and application procedures.

2.    Identify exempt and countable resources under Medicaid rules, particularly for married couples.

3.    Calculate income eligibility for both single and married individuals seeking Medicaid coverage.

4.    Analyze the implications of the Medicaid lookback rule and its impact on penalty calculations.

5.    Evaluate the role of gifting and estate recovery in Medicaid planning.

6.    Explore alternative funding options for long-term care, including LTC insurance, Medicare, State Partnership Plans, and Veterans Benefits.

7.    Recognize the criteria, coverage, and eligibility requirements for Veterans Benefits programs.

8.    Apply strategies to navigate barriers to coverage and maximize benefits for clients requiring long-term care.
