Description

Ethical pitfalls lurk in every corner of legal practice, from conflicts of interest to improper client disclosures. This CLE course will explore some of the most common ethical traps lawyers encounter and provide practical strategies to navigate them. Through an in-depth analysis of ABA Model Rules, real-world case studies, and best practices for conflict management, attorneys will gain valuable insights into mitigating ethical risks while maintaining compliance with professional responsibility standards. This course is essential for attorneys who want to strengthen their ethical decision-making, avoid costly missteps, and protect their clients and reputations.

Learning Objectives:

  1. Identify common conflict-of-interest scenarios under ABA Model Rules 1.7, 1.9, and 1.10 and understand their implications.
  2. Analyze key case law examples where ethical violations led to malpractice claims or disqualification, such as Fiandaca v. Cunningham and RevoLaze LLC v. Dentons US LLP.
  3. Implement conflict-checking systems and technological tools to proactively prevent ethical breaches.
  4. Understand the impact of positional conflicts and personal relationships on legal ethics and client representation.
  5. Develop firm-wide protocols and training to ensure compliance with evolving ethical obligations.
  6. Recognize situations requiring independent or Cumis counsel and understand the ethical considerations involved.

Will Neinast is a Senior Associate at Nelson Mullins Riley & Scarborough LLP's Greenville, South Carolina office. He is a member of the firm's Litigation Team, focusing on complex business disputes, products liability, premises liability, professional liability, real estate, and probate litigation. Will has significant experience in high-exposure personal injury cases, including trucking and aviation accidents, and has successfully defended appeals as both primary and secondary counsel. He earned his Juris Doctor, cum laude, from the University of South Carolina School of Law, where he served as Associate Editor-in-Chief of the South Carolina Law Review. During his time there, he received the American College of Trial Lawyers Lewis F. Powell Jr. Medal for Excellence in Advocacy, the D. Reece Williams III Trial Advocacy Award, and the Nelson Mullins Riley & Scarborough Center on Professionalism Award. Prior to law school, Will obtained his Bachelor of Arts from Wake Forest University.
