In the ever-evolving landscape of consumer law, 2025 brings a host of new ethical challenges and regulatory shifts that attorneys must navigate with clarity and precision. This CLE program, led by ethics expert Heather L. Rosing, provides a timely “reset” on the professional responsibility rules most relevant to today’s consumer attorneys. The session will cover emerging issues in legal advertising, lead generation, fee-sharing, litigation funding, trust account management, and succession planning. Attendees will gain actionable insights into updated ABA Model Rules, recent California legislation, and best practices for ethically managing risk and modernizing their practices.

Learning Objectives:

  1. Identify and apply current rules and legislation governing legal advertising, lead generation, and solicitation practices, including Senate Bill 37 and California Business & Professions Code § 6155.
  2. Evaluate ethical considerations surrounding fee-sharing arrangements and third-party litigation funding in light of Rule 1.5.1, Rule 1.8.6, and Assembly Bill 931.
  3. Understand trust account obligations, including compliance with the Client Trust Account Protection Program (CTAPP) and strategies to mitigate wire fraud risks.
  4. Develop an ethically sound succession plan aligned with COPRAC Formal Opinion No. 2024-209.
  5. Strengthen overall risk management and professional responsibility practices in consumer-focused legal representation.

A Certified Specialist in Legal Malpractice Law, Heather has earned nationwide recognition for her adept handling of complex legal malpractice, fraud, breach of fiduciary duty, RICO, and professional negligence matters across state, federal, and arbitration forums. She also represents attorneys, judges, and commissioners in ethics proceedings before the State Bar of California and the Commission on Judicial Performance. Prior to launching her boutique firm, Heather served as general counsel and CFO of a prominent California firm.
