Building on the foundational principles of effective cross-examination, Part 2 focuses on one of the most powerful tools in a trial lawyer’s arsenal: impeachment by prior inconsistent statement. This program breaks down impeachment into a clear, three-step framework that is practical, disciplined, and courtroom-tested. Participants will learn how to prepare strategically for impeachment, execute inconsistencies with precision, and avoid common mistakes that weaken credibility attacks. The course also explores impeachment by omission, techniques for confronting evasive or dishonest witnesses, and a flexible cross-examination structure that can be applied to virtually any adverse witness.
Learning Objectives:
1. Explain the three-step framework for impeachment by inconsistent statement and apply it in a courtroom setting.
2. Prepare effectively for impeachment by identifying contradictions, omissions, and credibility vulnerabilities in advance of trial.
3. Differentiate between impeachment by contradiction and impeachment by omission, and determine when each strategy is appropriate.
4. Execute impeachment in a controlled and persuasive manner without arguing with the witness or losing jury goodwill.
5. Identify common impeachment pitfalls that can undermine effectiveness or draw sustained objections.
6. Apply a flexible cross-examination structure to address evasive, dishonest, or unreliable witnesses.
7. Analyze practical hypotheticals to reinforce how impeachment principles operate in real-world trial scenarios.
