This CLE course will guide attorneys through the evolving field of companion animal law, with a focus on damages and recovery options when harm occurs to a companion animal. Participants will gain a comprehensive understanding of how courts currently treat companion animals, explore theories of recovery, and examine key cases and statutes shaping this area of law. We will also discuss potential challenges and limitations in litigating these cases, including civil rights claims and the implications of emotional distress and property law. By the end of this course, attendees will be equipped to advocate effectively for clients dealing with the loss or harm of a beloved companion animal.
Learning Objectives:
1. Identify and explain the primary legal theories and recovery options available for harm to or loss of a companion animal.
2. Discuss the concept of animals as property and the implications for damage calculations, including market and special value considerations.
3. Analyze critical case law and statutory provisions that influence recovery for harm to companion animals, including civil rights claims related to police shootings.
4. Evaluate the limitations and challenges of pursuing emotional distress and loss of companionship claims in various jurisdictions.
5. Apply knowledge of statutes and precedents to develop effective legal strategies for clients in cases involving companion animal harm.
