California Reporting Obligations: Navigating New Rule 8.3 is designed to help attorneys understand their duties under the newly enacted Rule 8.3 of the California Rules of Professional Conduct. The course will cover the requirements for mandatory and permissive reporting of attorney misconduct, the scope of reportable conduct, and exceptions based on privileged and confidential information. Participants will gain a clear understanding of how to navigate reporting obligations while ensuring compliance with ethical standards.

Learning Objectives:

  1. Understand Mandatory Reporting Under Rule 8.3: Identify the types of misconduct that must be reported, including criminal acts and conduct involving dishonesty, fraud, or misappropriation.
  2. Recognize Permissive Reporting: Learn the difference between mandatory and permissive reporting and when attorneys may report violations of professional conduct.
  3. Apply Exceptions to Reporting: Understand the limits on mandatory reporting, including situations involving privileged information and consultations with ethics hotlines or substance use programs.
