Trauma survivors often interact with the legal system in ways that can appear inconsistent, fragmented, or counterintuitive — but these behaviors are grounded in well-documented neurobiological responses to trauma. For lawyers representing or interviewing trauma survivors, understanding how trauma affects memory, communication, and behavior is essential to conducting ethical, effective, and victim-centered legal work. In this program, Deborah Hogan and Laura Feldman draw on decades of advocacy and litigation experience to provide a comprehensive introduction to trauma’s impact on the brain, trauma-informed interviewing techniques, and best practices for representing survivors of sexual assault and harassment. Participants will learn how trauma affects memory consolidation, why “counter-intuitive” behaviors are normal, how to build rapport and trust with clients, how to avoid common defense misconceptions, and how to ethically navigate pleadings, depositions, credibility challenges, and corroboration.
