Trauma survivors often interact with the legal system in ways that can appear inconsistent, fragmented, or counter-intuitive — but these behaviors are grounded in well-documented neurobiological responses to trauma. For lawyers representing or interviewing trauma survivors, understanding how trauma affects memory, communication, and behavior is essential to conducting ethical, effective, and victim-centered legal work. In this program, Deborah Hogan and Laura Feldman draw on decades of advocacy and litigation experience to provide a comprehensive introduction to trauma’s impact on the brain, trauma-informed interviewing techniques, and best practices for representing survivors of sexual assault and harassment. Participants will learn how trauma affects memory consolidation, why “counter-intuitive” behaviors are normal, how to build rapport and trust with clients, how to avoid common defense misconceptions, and how to ethically navigate pleadings, depositions, credibility challenges, and corroboration.
Learning Objectives:
1. Explain the neurobiological effects of trauma, including memory fragmentation, tonic immobility, and critical incident amnesia.
2. Identify common “counter-intuitive” survivor behaviors and understand why they occur.
3. Apply trauma-informed interviewing techniques to improve rapport, reduce harm, and elicit more accurate and complete information.
4. Recognize how trauma may influence defense strategies, credibility critiques, and common myths used to undermine survivors.
5. Implement best practices when drafting pleadings, preparing survivors for depositions, and anticipating trauma-based challenges.
6. Evaluate when and how to use corroborating evidence, expert testimony, and supportive advocates throughout representation.
