Description

Effective negotiation is as much about psychology as it is about law. This CLE provides attorneys with a practical, behaviorally informed framework for negotiating more effectively by understanding anchoring, framing, and concession strategies. Drawing on real-world legal negotiations, the program explores how cognitive biases shape decision-making, how bargaining styles influence outcomes, and how lawyers can strategically deploy opening offers, concessions, and framing techniques without sacrificing credibility or long-term relationships. Attendees will leave with concrete tools to improve negotiation outcomes while maintaining professionalism and client trust.

Learning Objectives:

1.    Identify common bargaining styles and assess how different negotiation approaches affect legal outcomes and professional relationships.

2.    Recognize key cognitive biases—such as anchoring, framing, and loss aversion—and evaluate their impact on negotiation dynamics.

3.    Apply strategic opening offers and framing techniques to shape negotiation expectations ethically and effectively.

4.    Implement concession strategies, including conditional concessions and issue trading, to maximize value while preserving goodwill.

5.    Mitigate cognitive bias in negotiation through objective criteria, perspective-taking, and interest-based analysis
